Terms and Conditions

1. Introduction

These Terms and Conditions (“Agreement”) govern the sale of products and services provided by Cyberworks PC (“Cyberworks PC,” “we,” “our,” or “us”). By purchasing products or services from Cyberworks PC, the customer (“Customer,” “you,” or “your”) agrees to be bound by these Terms and Conditions.

2. Services Provided

Cyberworks PC provides the following products and services:

  • Custom gaming PCs

  • Professional workstations

  • PC component and parts sales

  • Custom system assembly

  • Hardware installation and upgrades

  • Shipping and delivery services

Customers may also provide their own components for use in custom system builds.

3. Quotes and Pricing

All quotes provided by Cyberworks PC are valid for 7 calendar days unless otherwise stated. Due to market fluctuations and supplier pricing changes, component availability and pricing may change without notice after the quote expiration period.

Cyberworks PC reserves the right to substitute equivalent or superior components if original parts become unavailable, provided the substitution does not materially reduce system performance or value.

4. Deposits and Financing

Deposits are only required for financed inventory, special-order components, or systems ordered through payment arrangements.

Deposits are non-refundable once parts have been ordered or work has commenced unless otherwise required by law.

Failure to complete payment arrangements may result in cancellation of the order and forfeiture of the deposit.

5. Customer-Supplied Parts

Customers may provide their own components for use in a custom build. By supplying parts, the Customer acknowledges and agrees that:

  • Cyberworks PC is not responsible for manufacturer defects, incompatibilities, or failures of customer-supplied components.

  • Warranty coverage from Cyberworks PC does not extend to customer-supplied parts.

  • Labor fees remain non-refundable once installation work has been completed.

  • Compatibility issues resulting from customer-provided hardware may require additional labor charges.

Cyberworks PC reserves the right to refuse installation of damaged, unsafe, counterfeit, or incompatible components.

6. Warranty Coverage

Cyberworks PC provides a limited 12-month warranty on all complete custom system builds beginning on the original date of sale.

This warranty covers:

  • Assembly defects

  • Hardware installation issues caused by Cyberworks PC

  • Failures resulting from workmanship under normal use

This warranty does not cover:

  • Physical damage

  • Liquid damage

  • Electrical surges or improper power usage

  • Damage caused by misuse, neglect, or improper handling

  • Unauthorized modifications or repairs

  • Software-related issues not caused by Cyberworks PC

  • Viruses, malware, or operating system corruption

  • Damage caused by overclocking beyond manufacturer-recommended specifications

  • Cosmetic wear and tear

  • Customer-supplied components

Warranty service may require inspection and diagnostic testing before approval.

Cyberworks PC reserves the right to repair, replace, or substitute components at its discretion.

7. Overclocking and Performance Modifications

Overclocking, undervolting, BIOS modifications, or other performance tuning may increase system instability and hardware stress.

Cyberworks PC is not liable for damage, instability, shortened component lifespan, or hardware failure resulting from:

  • User-applied overclocking

  • Third-party tuning software

  • Manual voltage adjustments

  • Unauthorized BIOS modifications

Any warranty claim involving modified system settings may be denied if the modification contributed to the issue.

8. Returns and Refunds

Refunds may be issued for complete systems returned in undamaged, original condition within an approved return period determined by Cyberworks PC.

Returned systems must:

  • Be free from physical damage

  • Include all original accessories and packaging where applicable

  • Not show evidence of misuse, tampering, or modification

Cyberworks PC reserves the right to:

  • Deny returns for damaged or altered products

  • Apply reasonable restocking fees when necessary

  • Refuse refunds for custom-ordered components or special-order items

Shipping costs are non-refundable unless otherwise required by law.

9. Shipping and Delivery

Cyberworks PC may ship systems and components through third-party carriers.

Once a shipment has been transferred to the carrier:

  • Risk of loss or damage passes to the Customer, subject to applicable law

  • Shipping timelines are estimates only

  • Delivery delays caused by carriers, weather, supply shortages, or other circumstances outside our control are not the responsibility of Cyberworks PC

Customers are responsible for:

  • Inspecting shipments upon delivery

  • Reporting shipping damage promptly

  • Retaining original packaging for insurance claims when necessary

Cyberworks PC is not liable for damage caused during transit by third-party shipping carriers, though we may assist customers in filing shipping claims when applicable.

10. Delays and Backorders

Component shortages and supplier delays may affect order timelines.

Cyberworks PC is not liable for delays caused by:

  • Manufacturer shortages

  • Supplier backorders

  • Shipping carrier disruptions

  • Customs delays

  • Events outside reasonable business control

Estimated completion or delivery dates are not guaranteed.

11. Chargebacks and Payment Disputes

By purchasing from Cyberworks PC, the Customer agrees to contact us directly to resolve any billing or order concerns before initiating a payment dispute or chargeback.

Fraudulent or unjustified chargebacks may result in:

  • Suspension of warranty services

  • Denial of future business

  • Collection actions where permitted by law

Cyberworks PC reserves the right to provide transaction records, delivery confirmations, communication records, and signed documentation to financial institutions in defense of disputed charges.

12. Limitation of Liability

To the maximum extent permitted by law, Cyberworks PC shall not be liable for:

  • Indirect or consequential damages

  • Loss of data

  • Loss of profits or business interruption

  • Software corruption

  • Third-party service failures

  • Component manufacturer defects

Cyberworks PC’s total liability shall not exceed the original purchase price of the affected product or service.

13. Customer Responsibilities

Customers are responsible for:

  • Backing up all personal data before service or repair

  • Maintaining proper ventilation and operating conditions

  • Using surge protection and approved power equipment

  • Installing software responsibly

Cyberworks PC is not responsible for data loss under any circumstance.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted under the laws of the State of Iowa and applicable United States laws.

Any disputes arising under this Agreement shall be resolved in the appropriate courts located within the State of Iowa.

15. Changes to Terms

Cyberworks PC reserves the right to modify these Terms and Conditions at any time without prior notice. Updated terms become effective upon publication or customer notification.
